GST exemption sought on Covid drugs, equipment

  A plea has been filed by NGO Public Policy Advocates before the Supreme Court seeking an exemption for Covid-19 drugs remdesivir, tocilizumab, favipiravir and other drugs with a similar generic composition and related medical equipment from Goods and Service Tax (GST). It asked for a direction to the Central government to invoke its powers under Section 11 of the Central GST Act 2017 to lift imposition of GST on medical grade oxygen, oxygen concentrators, ventilators, Bipap machines, control measures and supportive care for Covid-19 patients in view of demand for these drugs and medical equipment having increased exponentially. Accusing the GST Council of showing total apathy by not recommending an exemption on such drugs and equipment to the Central government, the NGO has sought exemption of 12% GST imposed on such drugs and equipment, which would make treatment much more affordable to the public. How much gold you can hold under income tax rules

  Gold possession is one of the most revered investments in India. However, having gold beyond a certain limit can be problematic, if you don't have its invoice. According to the Central Board of Direct Taxes (CBDT) guideline, there is certain limit beyond which gold without invoice can be quizzed under Section 132 of the Income Tax Act. The Income Tax Department also says that if you buy gold, then you must mention about it in the asset details while filing your Income Tax Return (ITR) for that year. Income Tax: How TDS provision applies on rent paid

With an aim to negate chance of tax evasion, the Income Tax Department incepted Tax Deduction at Source (TDS) on transaction in certain cases, which includes rental payment. As per the income tax law, TDS on rent paid can be categorised in two parts — rent paid buy a businessman and rent paid by an individual or Hindu Undivided Family (HUF). TDS on rent paid by a businessman is mentioned in Section 194 I while TDS on rent paid by an individual or HUF is mentioned in Section 194 IB of the Income Tax Act. Speaking on the TDS provision on rent paid by an individual Mumbai-based tax and investment expert Balwant Jain said, "For an individual or HUF, if the monthly rent is ₹50,000 or more, then the renter will have to deduct 5 per cent of the total monthly rent under Section 194 IB." Zomato IPO: Food delivery platform aims to raise Rs 8,250 crore, Info Edge will sell a part of its investment

  Food delivery platform Zomato has filed its Draft Red Herring Prospectus (DRHP) with the market regulator today, kicking off one of India's most anticipated internet initial public offerings (IPOs) in a tumultuous year. According to the DRHP filed by Zomato, the company will offer equity shares aggregating up to Rs 8,250 crore (nearly $1.1 Billion). Of this, Rs 7,500 crore will be fresh issue, while Rs 750 crore will be an offer for sale for its existing investor Info Edge. Info Edge on April 27th said said it will sell shares worth Rs 750 crore in the upcoming initial public offering. 80% MSMEs, startups urge FM Sitharaman to extend GST payment, return filing deadlines without penalty

  The government had last week announced the extension of the deadline for payments under the Direct Tax Vivad Se Vishwas Act, 2020, and some compliances under the Income Tax Act by two months till June 30. MSMEs and startups, reeling under the Covid impact, have urged the government to extend the GST payment and return filing deadlines for the month of March, April, and May to June 30, 2021. According to a recent survey of MSMEs and startups by community social media platform LocalCircles, as much as 80 per cent respondents suggested extension of deadlines describing challenges faced in filing GST payments and returns for the month of March. Finance Minister Nirmala Sitharaman had provided a similar extension on ITR filing and GST return deadline last year. “MSMEs and startups have been requesting extension of the GST payment and filing deadlines as in many states there have been curfew and lockdown restrictions that have been imposed since early or mid-April preventing them from ...

COVID-19 relief: Govt. allows businesses to verify monthly GST returns through EVC till May 31

  The government has allowed businesses to verify through electronic verification code monthly GST returns filed till May 31. In a notification, the Central Board of Indirect Taxes and Customs (CBIC) said any registered person during the period from April 21, 2021, to May 31, 2021, will be allowed to furnish the return in Form GSTR-3B and details of outward supplies in Form GSTR-1 verified through electronic verification code (EVC). Currently, businesses are required to digitally sign the GSTR-3B form while filing the monthly return and paying taxes. However, with offices shut due to the lockdown, businesses are unable to generate a digital signature that has led to delay in filing returns. Sebi levies fine of Rs 1.75 crore on several entities in Vakrangee case

  Markets regulator Sebi on April 26 imposed a total fine of Rs 1.75 crore on several entities for indulging in fraudulent trading in the scrip of Vakrangee Ltd. The entities have violated Prohibition of Fraudulent and Unfair Trade Practices norms, Sebi said in three separate orders. The investigation periods vary between January 2015 and September 2015, September 2015 and June 2016 and September 2016 and June 2017. The probe found that the connected entities traded in the scrip of Vakrangee and created a misleading appearance of trading in the scrip without any intention of change in ownership of the security, by entering into synchronized trades at the relevant times. Trades among the entities were not genuine and were executed with manipulative intent. They were a part of fraudulent scheme and the synchronized trades have created misleading appearance of trading in the scrip of the company, Sebi said. Income tax rules: What if HUF's Karta transfers money personal account to HUF?

  The money transferred by the Karta of the HUF may either be treated as loan if the same is intended to be repaid or it can be treated as gift if the money is not intended to repaid. As per Section 56(2) any gift received from specified relatives is tax free in the hands of the recipient. A member of the HUF is treated as relative of the HUF hence there is no tax implication at the time of the receipt of the money for HUF. However, due to the clubbing provision income earned by the HUF on the money gifted by its Karta will be treated as income of the Karta and will be added to his income year after year. The clubbing provisions will apply till the assets of the HUF are fully partitioned. Please note that it is only income on the asset transferred which will be subject to clubbing provision and not the income earned on the income which will be clubbed under the clubbing provision. After the general lockdown, the revenue growth was almost restored to normal in the last quarter of 2020-21. “March witnessed an 18 pc growth in GST, the second highest growth rate in the just-concluded fiscal.
