I-T Dept detects ₹400 cr unaccounted transactions after raids on Kanpur-based pan masala group

The Income Tax Department on Friday carried out a search operation on a large group based in Kanpur and Delhi. The group is in the business of manufacturing Pan Masala and in real estate. A total of 31 premises were searched spread across Kanpur, Noida, Ghaziabad, Delhi and Kolkata. In a detailed statement, the Ministry of Finance informed that the group had been earning huge amounts through unaccounted sale of Pan Masala and through unaccounted real estate business. "This unaccounted income was laundered back into the concerns through a vast link of shell companies," it said. Digital and paper evidence found during search revealed a nation-wide network of such paper companies created by the group, the ministry further said. During the search operation, the department found that the directors of these companies were persons of no financial means. Gujarat govt transfers 36 officials for ‘fair probe’ into Rs 1,000 cr fake GST bill case

In connection with a case involving more than Rs 1,000 crore of fake GST (Goods and Services Tax) bills in Bhavnagar, the Gujarat government on Friday transferred 36 officials from Bhavnagar ranging from the deputy state tax commissioner to employees as junior as a clerk. The move is to ensure fair probe into the case where 11 persons have already been arrested in last one month. Deputy chief minister Nitin Patel in an official statement made the announcement about the transfers made in Bhavnagar so that the “investigations remain unaffected” and the “records are not tampered with.” A senior official from the state commercial tax department told The Indian Express , “These transfers are part of a fresh case that was detected about a month back where more than Rs 1,000 crore of fake bAbout 11 persons have already been arrested in this case. “They had used fake firms to generate bogus bills and took input tax credit on the same, thus defrauding the state government,” the official added. ...

Technical glitches continue to affect the functioning of the new income tax portal, restricting taxpayers and practitioners from carrying out tax-related works. The Income Tax Department had launched the new e-filing portal on June 7. Since then, it continues to face technical issues. Practitioners claim the portal has not been working since its launch in June, the peak time of filing returns. Even as the deadline for filing the I-T returns is September 30, many want to file it well on time to avoid the last minute rush. Centre-State action to plug GST revenue leak

  GST officers of Andhra Pradesh and the Central governments met here on Thursday to discuss ways to plug revenue leak through coordinated efforts and information sharing. They have drawn up an action plan to monitor and pursue cases where GST returns were not filed, particularly in businesses with a turnover of over `5 crore. In the last four years since the implementation of GST, the major source of revenue leakage has been the unlawful or bogus claims related to Input Tax Credit (ITC) with fictitious invoices, according to the officials.   Chief Economic Adviser (CEA) K V Subramanian on Thursday said that rationalisation of GST rate structure is on the government's agenda and it is definitely going to happen. Further, he said that a three-rate structure is very important and there is also a need to fix inverted duty structure as far as the GST is concerned. The Goods and Services Tax (GST), which amalgamates more than a dozen central and state levies like excise duty, service tax and VAT, was introduced in July 2017. GST currently has five rate structures -- 0.25 per cent, 5 per cent, 12 per cent, 18 per cent and 28 per cent. DGGI detects Rs 278 crore GST evasion in railway purchases since July 2017

The Directorate General of GST Intelligence (DGGI) has detected tax evasion worth Rs 278 crore by bidders who were awarded railway tenders since 2017. The probe by the investigation agency relates to instances of misclassification of rail supplies by winning bidders of railway tenders, the Parliament was informed. In March, Business Standard had reported that DGGI has initiated an investigation into tenders awarded by the Indian Railways since July 2017 after complaints were made by the Central Board of Indirect Taxes and Customs (CBIC) and the Department for Promotion of Industry and Internal Trade (DPIIT) to the Ministry of Railways. It was found that bidders were indulging in the malpractice of quoting low GST rate to win bids and evade GST by misclassifying the supplies to the national transporter. India levies one of the highest taxes on petrol and diesel in the world. At present, 60 percent tax is being collected on petroleum products. Currently, petrol, diesel and other associated products are not subject to GST (Goods and Services Tax), but are subject to excise tax (by the Union government) and VAT (value added tax levied by each state at different rates). The excise duty from petroleum products contributes up to 90 percent of all excise duty collected by the Centre. The Centre levies an excise duty of Rs 33 on a litre of petrol. VAT varies from state to state. Rajasthan levies the highest local taxes on petrol and diesel, followed by Madhya Pradesh, Maharashtra, Andhra Pradesh and Telangana. Before May 2014, excise duty on petrol was Rs 9.48 per litre - the current rate is almost three times. On diesel, central taxes were Rs 3.56 a litre, prior to 2014. Centre not in favour of extending GST compensation period beyond 5 years

  The Centre argued that GST revenues should grow, instead of it paying compensation to the states. Moreover, the Centre pitched that States should revisit rates, correct inverted duties, and increase compliance so that a more long term, stable source of revenue is available to them over a period of time. The States had requested the Centre to extend the GST compensation period by five years, beyond FY22 due to the severe shortfall in revenue owing to disruption in economic activity. The 101st amendment of the GST Constitutional Act of 2016 included a provision to compensate the States for loss of revenue due to the implementation. According to the provision, revenue shortfalls arising from the implementation would be made good from a GST Compensation Fund for a period of five years. This period is set to end in 2022.
